Domestic assault charges are assault charges, so the assault sections of the Criminal Code set out the maximums. Section 266 makes assault a hybrid offence. On indictment, the maximum is five years. Section 267 covers assault with a weapon, assault causing bodily harm, and assault by choking, suffocating or strangling. For these the maximum is up to 10 years on indictment, or the offence can be a summary conviction one. Unless another penalty is set, s. 787(1) says a summary conviction offence carries a fine of up to $5,000, imprisonment of up to two years less a day, or both. The charge named on your paperwork shows which section applies, and a lawyer can explain it to you in plain terms.

Release is often the first question after an arrest. Under s. 515, a justice must release an accused without conditions unless the prosecutor shows cause why detention or conditions are justified. Duty counsel is a lawyer at the courthouse for that day. For people who qualify and have no lawyer, duty counsel can advise on rights, act at a bail hearing and ask to delay a court date.
