Sexual assault is a charge under the Criminal Code. Section 271 sets the penalties. On indictment, the maximum is up to 10 years. If the complainant is under 16, the maximum is 14 years, with a one-year minimum. On summary conviction, the maximum is up to two years less a day, and there is a six-month minimum if the complainant is under 16. Unless another penalty is set, s. 787(1) says a summary conviction offence carries a fine of up to $5,000, imprisonment of up to two years less a day, or both. These are the limits the law sets. They say nothing about what will happen in any one case.

Each is a separate charge, so read the one that matches the charge on your paperwork. A lawyer can tell you which charge you face and what the section says about it.
A person who is charged has the right to be presumed innocent until proven guilty, and the right not to be denied reasonable bail without just cause. Both come from s. 11 of the Charter. The Superior Court of Justice can try any indictable offence but generally tries only the most serious, such as sexual assault. A listing on this page is not a recommendation, and the page does not rank lawyers. It is general information, not legal advice.
