Drug charges are laid under the Controlled Drugs and Substances Act, a federal law. Under s. 4, possessing a Schedule I substance carries up to seven years on indictment. On summary conviction, a first offence carries a fine of up to $1,000, up to six months, or both. Under s. 5, trafficking, or possession for the purpose of trafficking, a Schedule I or II substance is indictable with a maximum of life imprisonment. These are the limits the law sets. They say nothing about what will happen in any one case. The Act sets the penalties by the kind of substance and by what the charge alleges, which is why the difference between possession and trafficking matters so much when you first read a charging document.

Every charge under the Criminal Code, the Controlled Drugs and Substances Act, the Youth Criminal Justice Act and most other federal statutes starts in the Ontario Court of Justice, and about 95% are completed there. The Superior Court of Justice can try any indictable offence but generally tries only the most serious, and its list includes drug trafficking.
