A criminal appeal asks a higher court to review a decision. Where the appeal goes depends on how the case was decided. An appeal of a summary conviction goes, in Ontario, to the Superior Court of Justice in the region, district or county where the case was decided (s. 812(1)(a), s. 813). An appeal from a conviction on indictment goes to the court of appeal. That appeal is as of right on a question of law alone. It needs leave, meaning permission, on questions of fact or mixed law and fact, and it also needs leave to appeal a sentence (s. 675(1)). Which route applies depends on how the case was decided, so the first step is to read the decision and the charge. A lawyer can explain the route that fits.
In Ontario, 299 lawyers are listed here as taking criminal appeals and Charter applications. Seventeen cities have their own page for this charge. Toronto has 102 listed lawyers, Ottawa 27, Mississauga 25, Brampton 24 and North York 14. London has 10, Kitchener and Windsor each have 7, and Scarborough and Oshawa each have 5. The city pages list the lawyers in each place. If you are looking for a lawyer for an appeal, the page for the city nearest to you lists the lawyers there. Smaller places are covered by nearby cities.
The national guides linked on this page explain criminal appeals and Charter applications. They are the place to start if you want plain-language detail on either one. A Charter application asks a court to rule on whether a right under the Charter was breached. A lawyer can explain whether one is worth raising in a case.
Charter applications are often tied to evidence. Section 24(2) says evidence obtained in a way that infringed Charter rights is excluded if admitting it would bring the administration of justice into disrepute. This page does not say whether that section applies to any case. A listing on this page is not a recommendation, and the page does not rank lawyers. It is general information, not legal advice.
